Convergence

Counter Malign Foreign Influence

This event has been postponed due to the federal government shutdown and will be rescheduled in 2026

The U.S. approach to foreign investment has undergone a decisive shift in 2025, as new policies more tightly link economic and national security. The America First Investment Policy (NSPM-3) and the Treasury’s final Outbound Investment Rule have sharpened the focus on both inbound and outbound capital flows involving countries of concern. At the same time, the 2024 CFIUS Annual Report to Congress highlights stricter enforcement, including increased scrutiny of non-notified transactions, higher civil penalties, and evolving expectations regarding mitigation agreements. The U.S. Steel–Nippon Steel acquisition, finalized this summer with conditions including a government “golden share,” underscores how far the definition of “national security concern” has expanded. Together, these developments raise new questions for industry, investors, and regulators alike.

About the Event

The Convergence to Counter Malign Foreign Influence will bring together leaders from government, financial services, and industry to discuss the implications of recent policy and enforcement changes. The half-day event comprises a mix of interactive discussions and working sessions to understand how legislation surrounding FOCI and the stakeholders responsible for executing it (i.e., CFIUS, DCSA, OFAC) will impact strategic positioning in 2026 and beyond. Participants will have the opportunity to share best practices across private and public sectors, discuss new ideas for cross-sector collaboration, and consider how innovative technologies can be leveraged to handle the growing scale and complexity of this challenge.

This event has been postponed due to the federal government shutdown and will be rescheduled in 2026.
